What is a Notary Public?
A Notary Public is an official appointed by a state government to serve the public as an impartial witness during notarizations. As ministerial officials, they are expected to follow statutory rules without the exercise of significant personal discretion.
Notaries Public certify the proper execution of life changing documents of private citizens- whether the transactions convey real estate, grant powers of attorney, establish a prenuptial agreement, or perform the multitude of other activities that enable our civil society to function.
How much does a mobile notary charge?
California law limits the amount to $15 per signature and a notary may charge travel fees, service fees, etc… It is up to the mobile notary’s discretion.
Why are documents notarized?
Some documents are required to be notarized or to have an impartial witness to the signing. It is serves as a deterrent to fraud. The notary makes sure the signers have entered into the agreement(s) willingly and knowingly, and are of sound mind, present proper identification, and will administer an oath when required.
Do I have to appear in front of the notary to get my document notarized?
Yes, in the state of California the signer must personally appear in front of the notary at the time of notarization. A California notary public can not perform notarial services online. Remote online notarizations (RON) via webcam are illegal and invalid.
May a notary public give legal advice or draft legal documents?
No. The notary public is forbidden from preparing legal documents for others or acting as a legal advisor. The notary public is also not responsible for the accuracy or legality of the documents they notarize. The notary public can only certify the identity of the signers of the documents.
Why can’t I get a blank document notarized?
A document must be complete and have no blanks to be notarized.
